Buying Property in Spain

Is buying in Spain is just like buying in the UK? You might think so with more than one million British citizens living along the Spanish coast. But the Spanish legal system is completely different from the British.

From the moment you have found your dream villa we will use our expert knowledge to take the worry from you. We will arrange for a valuation report and instruct your lawyer to begin legal searches on the land and buildings, and prepare the draft purchase agreement.

Resales

If you are purchasing a resale home, we will help you agree a preliminary contract with the vendor to commit him to sell it to you at the stated price within the terms of the contract. After you have signed this contract, your lawyer will complete the checks before you sign the escritura. This usually takes between 4 and 8 weeks.

New properties

If you plan to buy new, we will ask you to sign a reservation contract once you have made your choice. We will then help you agree the full preliminary contract, at which time we will ask you to pay a deposit.

If you are purchasing a home to be built for you, there are several options, and we will advise which is best route for you.

If you are purchasing a plot of land from a builder or developer who is also building the house, you could buy the land outright, plus whatever construction has already been built, and then agree a separate completion contract.

If you are purchasing a villa or apartment on a complex, we will ask you to sign a contract in which you agree to buy it on completion. You will make payments as the construction progresses, and your final payment - made in the notary's office - will transfer ownership to you. We can advise you on the best way to make these payments to give you most security.

When purchasing on a complex, you'll probably be buying into an owner's community, a legal entity, an organisation of owners, who jointly manage and pay for common facilities such as pools, parking areas, lifts, external lighting, gardens, etc. This will not effect the ownership of your home, which you will own entirely. The community can charge fees which may vary according to the amount of maintenance work, for which all owners are responsible.

Completing your purchase

The legal transfer will take place with a notary present who will based in the area where your home is being purchased. The notary will prepare the escritura and register it and charge both you and the vendor, according to a fee schedule set by government.

We will advice you how and when to arrange your finances so you are ready to sign the deed to transfer on the agreed date.
